PUBLIC OFFER FOR VOLUNTARY CHARITABLE DONATIONS
This offer, addressed to an indefinite circle of individuals - both physical and legal entities - visitors of the website on the Internet: https://www.poryatunok.org.ua (hereinafter referred to as the "Website"), further referred to as the "Donor", is an official and public proposal by the International Charitable Foundation "Poryatunok", hereinafter referred to as the Charitable Foundation "Poryatunok", represented by its founder Dmytro Yuriyovych Damaskin, acting on the basis of the Charter, to conclude a contract of voluntary charitable donation (hereinafter referred to as the "Contract"), the subject and essential terms of which are specified below:
1. TERMS AND DEFINITIONS
Acceptance is the full and unconditional acceptance of the Public Offer by performing actions to make a money transfer using payment forms and tools placed on the Website, as well as by transferring money to the settlement account of the Charitable Foundation "Poryatunok" through banking institutions. The moment of Acceptance is the date of crediting funds to the settlement account of the Charitable Foundation "Poryatunok". Payment is a voluntary charitable donation. A voluntary charitable donation is a monetary transfer made by the Donor to achieve the goals, tasks, directions, and types of statutory activities of the Charitable Foundation "Poryatunok" in accordance with the Agreement and the Law of Ukraine "On Public Associations".
SUBJECT OF THE CONTRACT
The subject of this contract is the gratuitous transfer by the Donor in favor of the Charitable Foundation "Poryatunok" of monetary funds to achieve the goals, tasks, directions, and types of statutory activities of the Charitable Foundation "Poryatunok". Acceptance of the Contract means that the Donor agrees to all its provisions, fully understands the subject matter of the Contract, and the purpose of the donations. The Contract is concluded by the unconditional and full accession of the Donor to this Contract and acceptance of all essential terms of the Contract. The Donor and the Charitable Foundation "Poryatunok", guided by the Law of Ukraine "On Public Associations", agree that the Contract is considered concluded in writing without the signature of a written copy by the Parties from the moment the Donor performs actions envisaged by the Contract, which indicate consent to abide by the terms of the Contract. The Contract is posted on the Website for public access and in a manner that ensures acquaintanceship with the content of this Contract by every person applying to the Charitable Foundation "Poryatunok". The Donor cannot propose their own terms of the Contract.
RIGHTS AND OBLIGATIONS OF THE PARTIES
The Charitable Foundation "Poryatunok" has the right to:
- receive voluntary charitable donations and use them to achieve the goals, tasks, directions, and types of statutory activities of the Charitable Foundation "Poryatunok" in accordance with the Contract and the Law of Ukraine "On Public Associations";
- at the request of the Donor, provide a report on the received voluntary charitable donation and its use.
The Donor has the right to:
- transfer the voluntary charitable donation to the account of the Charitable Foundation "Poryatunok" in the manner specified in the Contract;
- request a report on the use of the voluntary charitable donation.
PLACE OF FUNDRAISING
The collection of voluntary charitable donations is conducted within the territory of any country in the world.
FUNDRAISING PERIOD
Personal data is stored for no longer than necessary in accordance with the purpose of its processing.
EXPENSES
The collection of voluntary charitable donations continues until the liquidation of the Charitable Foundation "Poryatunok", unless another term is determined by the Charitable Foundation "Poryatunok".
OTHER CONDITIONS
The Donor independently determines the amount of voluntary charitable donation. The donation is voluntary and non-refundable. The Donor is responsible for the accuracy of the information provided during the donation transfer. In order to comply with the Law of Ukraine "On Personal Data Protection" and fulfill the terms of the Contract, the Donor consents to the processing of personal data. The relations between the Donor and the Charitable Foundation "Poryatunok" are governed by the provisions of Ukrainian legislation.
